1. Acceptance of Terms

By accessing or using PhotoShare ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

PhotoShare is an event photo sharing platform that enables event hosts to collect, organize, and share photos from guests. The Service includes:

  • Event creation and management
  • Photo upload and storage
  • Real-time photo walls
  • Secure sharing links with expiration controls
  • Photo tagging and filtering
  • Album downloads

3. User Accounts

3.1 Account Registration

To use certain features, you must create an account. You agree to provide accurate, current, and complete information and to update it as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access.

3.3 Account Types

  • Event Hosts: Create and manage events, control access, and manage photos
  • Guests: Upload photos to events they have access to via sharing links

4. Acceptable Use

You agree to use PhotoShare only for lawful purposes. You must not:

  • Upload content that infringes on intellectual property rights
  • Upload illegal, harmful, threatening, abusive, or obscene content
  • Upload content containing nudity or sexually explicit material
  • Harass, stalk, or harm other users
  • Impersonate any person or entity
  • Upload viruses, malware, or malicious code
  • Attempt to gain unauthorized access to our systems
  • Use the Service for spam or unsolicited advertising
  • Scrape, data mine, or harvest user information
  • Violate any applicable laws or regulations

5. Content and Intellectual Property

5.1 Your Content

You retain all ownership rights to photos and content you upload ("User Content"). By uploading User Content, you grant PhotoShare a non-exclusive, worldwide, royalty-free license to store, display, and transmit your content solely for the purpose of providing the Service.

5.2 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that you have all necessary rights to upload the content and that it does not violate any laws or third-party rights.

5.3 PhotoShare Property

The PhotoShare platform, including its design, features, and functionality, is owned by PhotoShare and protected by copyright, trademark, and other intellectual property laws.

6. Photo Sharing and Privacy

  • Event hosts control who can access and view photos in their events
  • Sharing links can be configured with expiration dates
  • Photos uploaded to an event may be visible to other event participants
  • Do not share confidential or sensitive information through photos
  • Respect the privacy of others when uploading photos

7. Payment and Subscriptions

7.1 Pricing

Certain features require payment. Current pricing is available on our website. We reserve the right to change pricing with notice.

7.2 Payment Terms

  • Payments are processed securely through third-party payment processors
  • All fees are in Philippine Pesos (PHP) unless otherwise stated
  • Subscriptions renew automatically unless cancelled
  • You authorize us to charge your payment method for applicable fees

7.3 Refunds

Refund requests are subject to our Refund Policy.

8. Content Moderation

We reserve the right, but not the obligation, to monitor, review, and remove User Content that violates these Terms or is otherwise objectionable. We may take action including:

  • Removing or disabling access to content
  • Suspending or terminating user accounts
  • Reporting illegal activities to authorities

9. Copyright and DMCA

We respect intellectual property rights. If you believe content on PhotoShare infringes your copyright, please see our Copyright Policy for instructions on filing a DMCA notice.

10. Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted access. The Service is provided "as is" and "as available" without warranties of any kind. We may modify, suspend, or discontinue any part of the Service at any time.

11. Limitation of Liability

To the maximum extent permitted by law, PhotoShare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from:

  • Your use or inability to use the Service
  • Unauthorized access to your account or content
  • Loss or corruption of data
  • Third-party conduct or content

Our total liability for any claims related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless PhotoShare from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason. You may terminate your account at any time through your account settings. Upon termination:

  • Your access to the Service will be revoked
  • You should download any photos you wish to keep
  • We may delete your account and content after a reasonable period
  • Paid subscriptions are subject to our Refund Policy

14. Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Any disputes shall be resolved in the courts of Metro Manila, Philippines.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
